By responding to our request with the hashtag #ortastore, you agree to the following:

You grant ORTA, through LES COMPTOIRS D'ORTA SPRL (hereinafter referred to as "ORTA"), a worldwide, non-exclusive, royalty-free license to use any photos or video content related to your response using #ortastore (hereinafter "photos and video content") for commercial and/or advertising purposes, including on the online store, emails, social media — both ORTA's social channels and paid social networks — in- store materials, external vendors working with ORTA, and other customer communications sent by ORTA or its partners. ORTA may use, reproduce, distribute, combine with other materials, alter and/or modify your photos and video content at its sole discretion.

By agreeing, you confirm and represent that (i) you own the rights to your photos and video content, (ii) you have permission to grant usage rights from anyone appearing in your photos and video content, (iii) you are 16 years of age or older, and (iv) the use of your photos and video content by ORTA does not infringe upon the rights of any third party or violate any laws. You hereby waive and release ORTA from any obligation to pay for the use of your photos and video content in connection with the above-stated purposes, and you waive, release, and agree to hold harmless ORTA and anyone acting on its behalf from any claims, demands, and liabilities in relation to the use of said photos and video content.

Why do we use your personal data?

We aim to share and inspire you and others on the many ways to wear our products and to give you the opportunity to showcase your look to the world. #ortastore is a service created for you and your audience, intended for collaborative marketing.

How do we use your personal data?

Photos and/or videos of you are considered personal data. These will be published on our official website and/or our social media accounts and other promotional channels.

Who has access to your personal data?

Your personal data may be shared within ORTA as needed. It may sometimes be shared with service providers who help us perform certain tasks, such as IT services, data analysis, and media agencies. ORTA remains fully responsible for these providers.

Please note that by adding a hashtag to your photo or video, you are voluntarily sharing content and other personal data with Instagram and other social media platforms. This relationship is beyond ORTA’s control and is strictly between you and the social media provider.

Unless otherwise stated, we do not transfer, sell, or trade your data to third parties.

What is the legal basis for processing your personal data?

We will collect, use, and share your username, photos, and/or videos to the extent necessary to provide the service and fulfill your expectations when using #ortastore and other user-generated content services.

How long do we keep your data?

We will retain your username and generated content for 24 months from the date of publication.
